The Fair Employment Housing Act (“FEHA”) protects transgender persons at work from discrimination and harassment and prohibits retaliation against individuals for reporting such discrimination and harassment. See Cal. Govt. Code §§ 12940(a), (b). This includes transgender persons who are transitioning, which the FEHA defines as “a process some transgender people go through to begin living as the gender with which they identify, rather than the sex assigned to them at birth. This process may include, but is not limited to, changes in name and pronoun usage, facility usage, participation in employer-sponsored activities (e.g. sports teams, team-building projects, or volunteering), or undergoing hormone therapy, surgeries, or other medical procedures.” Cal. Govt. Code § 11030(f).
Thus, you are protected if you are transitioning, have transitioned, or are perceived to be transitioning. This includes the right to tell your employer you are transitioning, the right to be addressed by your preferred name and pronouns. It also protects your right to dress consistently with your gender identity or expression.
