The Fair Employment Housing Act (“FEHA”) doesn’t just protect individuals at work against discrimination and harassment based on their sex (and retaliation based on reporting such discrimination and harassment) in a traditional narrow gender-based sense—it is much broader.
The FEHA defines “sex” as “include[ing], but [ ] not limited to, pregnancy; childbirth; medical conditions related to pregnancy, childbirth, or breast feeding; gender; gender identify; and gender expression, or perception by a third party of any of the aforementioned.” Cal. Govt. Code §§ 11030, 12926.
