Intersectionality has been codified. As described by the California Legislature, “Intersectionality is an analytical framework that sets forth that different forms of inequity operate together, exacerbate each other, and can result in amplified forms of prejudice and harm.” For example, often workplace discrimination or harassment isn’t against just someone’s race or someone’s gender, but it may be because they are a person of a certain race and gender. In other words, discrimination or harassment may be based on more than one protected characteristic.
The amendment goes into effect on January 1, 2025.
